Selecting the right expertise at the right stage can also have a material impact on the cost and efficiency of a matter. We also try to reduce duplication, avoid unnecessary work and ensure that professional resources are deployed where they add the greatest value.
Conflicts evolve. Positions change. Relationships develop. New information emerges. Advisers become involved. Negotiations may progress, stall or restart. Formal proceedings may become necessary.
The professional team may also need to evolve.
An adviser who was appropriate at one stage of a matter may not necessarily be the right fit for every stage that follows. As conflicts develop, the client may need to consider whether the expertise, approach and resources surrounding the matter continue to correspond to what the circumstances require.
Recognising when a change is needed is not always straightforward. As a matter develops, clients and advisers can become invested in an established course of action. Earlier assumptions may continue to shape decisions even as circumstances change, while the demands of an existing mandate can naturally favour continuity over reconsideration. The client, operating under pressure and without the benefit of comparison, may have limited visibility into whether a different strategy, additional expertise or a change in the professional team would better serve the objectives of the matter.
An independent perspective creates room to ask those questions. Not whether an adviser was the right choice when appointed, but whether the strategy, expertise and professional structure remain right for the circumstances as they exist today.
Our focus remains consistent: the client’s objectives and whether the strategy, structure and professional resources surrounding the client continue to serve them.
We provide continuity as circumstances change, helping the client maintain perspective across the different dimensions of the conflicts and the professionals involved. Where appropriate, this includes helping the client identify the expertise required, prepare for the selection of specialist counsel and consider whether the existing advisory structure remains appropriate as the matter develops.
This is not about second-guessing specialist advice. It is about ensuring that the client continues to have the right expertise, the right structure and the right perspective for the decisions ahead.
Our role is to listen, structure and challenge assumptions. To help the client assess priorities and consequences. To coordinate where multiple advisers or jurisdictions are involved. And to provide an independent perspective before consequential decisions are made.
